Description

This project attempts, through 20 selected problems that have been mostly drawn from the field of jurisprudence, to equip the reader with the theoretical tools necessary for the correct handling of the most important General Part issues of our Penal Code. At the beginning, a real incident corresponding to the minor proposition of deductive reasoning is presented, followed by the construction of the theoretical basis, which corresponds to the major proposition. In the theoretical processing of the work, the most significant decisions published until June 2005 were taken into account, both in the Greek and in the German-speaking legal press, as well as recent scientific opinions. The problems are classified into the following thematic units: causal connection, crimes committed by omission, defense, state of necessity, consent of the victim, possible and general intent, negligence, crimes discernible from the result, error about the person, accidental shooting, error about the actual conditions for the justification of the unlawful act, capacity for imputation, attempt and withdrawal, withdrawal from an unfinished attempt, moral perpetration, moral perpetration and attempt in crimes discernible from the result, indirect perpetration - moral perpetration - attempt, simple complicity and participation, and neutral actions. It is primarily aimed at judges and lawyers who wish to gain access to a specific criminal law problem of the General Part, but also at students interested in delving into the relevant issues.
